The agreement These terms are between you and Enhance More ("we", "us"), and govern your use of the website at enhancemo.com, the iOS application, and the related services (together, the "Service"). By creating an account or using the Service you accept these terms. If you are accepting on behalf of an organization, you confirm you have authority to bind that organization. Our Privacy Policy explains how we handle personal data and forms part of this agreement. ## 2. Accounts - You must provide accurate information and keep it current. - You are responsible for activity under your account and for keeping your credentials secure. - You must be old enough to form a binding contract where you live, and at least 16. - Tell us promptly if you believe your account has been compromised. You may delete your account at any time from Settings. Deletion is permanent. ## 3. Organizations The Service is organized around organizations. An organization's administrators can invite and remove members, assign roles, and access content their members create within that organization. If you joined an organization you did not create, that organization controls its workspace. It may be able to see, change, export or delete content you create there, and it may remove your access at any time. Where an organization is your employer, your use may also be subject to their own policies. ## 4. Acceptable use You agree not to: - break the law, or infringe anyone's rights, using the Service; - upload malware, or attempt to gain access to data or accounts that are not yours; - probe, scan, overload or disrupt the Service or its infrastructure; - reverse engineer or copy the Service except to the extent the law expressly permits; - resell or provide the Service to third parties unless we have agreed in writing; - use forms, chat or notifications to send unsolicited bulk messages. We may suspend access that we reasonably believe threatens the Service, its data, or other users. We will restore it as soon as the issue is resolved. ## 5. Your content You keep all rights to the content you put into the Service. You grant us only the licence we need to host, process, transmit, back up and display it in order to operate the Service for you. You are responsible for your content and for having the right to use it — including any personal data you collect through forms, for which you are the controller and must have your own lawful basis and notice. You can export or delete your content through the Service. When an organization is deleted, its content is deleted with it. ## 6. Plans and payment The Service has a free tier and a paid Pro plan. Paid plans are billed in advance on a recurring basis through our payment provider, and renew automatically until cancelled. - Prices are shown before you subscribe, exclusive of any applicable tax unless stated. - You can cancel at any time; access continues until the end of the paid period. - Except where the law requires otherwise, payments are non-refundable. - We may change prices with at least 30 days' notice before the change affects a renewal. Subscriptions purchased through the website are managed by us through our payment provider. If your organization's plan was purchased by an administrator, that administrator manages the subscription. ## 7. Availability and changes to the Service We work to keep the Service available, but we do not promise uninterrupted access. We may perform maintenance, and we may add, change or remove features. If we discontinue a feature your organization materially relies on, we will give reasonable notice. ## 8. Termination You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these terms, if required by law, or if continuing would create a security or legal risk — with notice where we reasonably can give it. On termination your right to use the Service ends. Sections that by their nature should survive — content ownership, disclaimers, liability, and governing law — continue to apply. ## 9. Disclaimers The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that it will meet your specific requirements. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected. ## 10. Limitation of liability To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, goodwill or data. Our total liability arising out of or relating to the Service is limited to the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or [MINIMUM LIABILITY FLOOR, e.g. USD 100]. You are responsible for keeping your own copies of content that matters to you. ## 11. Changes to these terms We may update these terms as the Service changes. The date at the top reflects the current version. For material changes we will give notice in the product or by email before they take effect. Continuing to use the Service after that means you accept the updated terms. ## 12. Governing law and contact These terms are governed by the laws of the State of New York, United States, and the courts of New York have exclusive jurisdiction, without affecting any mandatory consumer protections in your country of residence.
